These Terms & Conditions (“Terms”) govern your use of the BC Landscaping & Hardscape, LLC (“BC Landscaping & Hardscape,” “we,” “us,” or “our”) website and the landscaping, hardscaping, irrigation, lighting, tree, and maintenance services we provide. By using our website or requesting an estimate, scheduling, or accepting our services, you agree to be bound by these Terms.

1. Services Provided

BC Landscaping & Hardscape provides xeriscaping and desert design, grass and turf installation, hardscaping, irrigation systems, lightscape installation, tree services, lawn and garden maintenance, and concrete and retaining wall work throughout Phoenix, Scottsdale, Paradise Valley, Tempe, Mesa, Gilbert, Goodyear, Waddell, Fountain Hills, Rio Verde, Arcadia, and the surrounding Maricopa County communities we serve. The exact scope of any project is defined in the written estimate or proposal provided to the client prior to work beginning.

2. Estimates & Pricing

Estimates requested through our website or by phone are provided free of charge and are based on the information and property access available at the time of the estimate. Final pricing may be adjusted if actual site conditions, scope, or material availability differ from what was assessed. We will communicate any material change in scope or price before proceeding with additional work.

3. Scheduling & Property Access

Scheduled service dates are estimates and may shift due to weather, material availability, or circumstances outside our control. Clients are responsible for providing reasonable access to the property, including gates, irrigation controls, and any areas required to complete the agreed-upon work, during the scheduled service window.

4. Payment Terms

Payment terms, including deposits, progress payments, and final balances, are set out in the individual estimate or contract for each project. Recurring maintenance services are billed on the schedule agreed to at the start of service. Late or unpaid balances may result in a pause of scheduled or in-progress work until the account is brought current.

5. Workmanship Guarantee

We stand behind our work. Installation workmanship is covered under our workmanship guarantee for the period specified in your project agreement. This guarantee covers defects in installation and does not cover normal wear, damage from neglect, extreme weather events, unauthorized modifications, or issues caused by irrigation, drainage, or soil conditions outside our control. Plant material, sod, and manufacturer-supplied products (turf, lighting fixtures, irrigation components) are subject to their own manufacturer warranties where applicable.

6. Cancellations & Changes

We understand plans change. Please notify us as early as possible if you need to reschedule or cancel a scheduled service or project. Deposits for custom or material-intensive projects may be non-refundable once materials have been ordered or work has begun, as outlined in your project agreement.

7. Licensing, Insurance & Compliance

BC Landscaping & Hardscape performs all work in accordance with applicable Arizona licensing requirements and local HOA and municipal guidelines, where such guidelines apply to the scope of work. Clients are responsible for securing any HOA or architectural committee approvals required for their specific community prior to work beginning, unless permitting support is explicitly included in the project agreement.

8. Limitation of Liability

To the fullest extent permitted by Arizona law, BC Landscaping & Hardscape’s liability for any claim arising from our services is limited to the cost of the service or project in question. We are not responsible for pre-existing conditions on a property, including but not limited to underlying drainage issues, irrigation lines not disclosed prior to work, or damage caused by third parties after our work is complete.

9. Website Use

The content on this website, including text, images, and graphics, is the property of BC Landscaping & Hardscape and may not be copied or reproduced without permission. This website and the information on it are provided for general informational purposes and do not constitute a binding offer; all project pricing and scope are confirmed in a written estimate or contract.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services will be resolved in the courts of Maricopa County, Arizona.
